Heard learned counsel for the petitioner and learned A.G.A. for the State respondents.
By means of present writ petition, the petitioner is seeking direction to the respondent authorities to ensure fair, impartial and proper investigation of the FIR dated 14.10.2019 registered as Case Crime No.2233 of 2021 under Section 306 IPC, P.S. Indrapuram, District Ghaziabad.
Learned counsel for the petitioner in support of his submission states that in the present matter, the final report has been forwarded to the competent court but the same was eventually rejected by the Chief Judicial Magistrate, Ghaziabad vide order dated 16.9.2020 with direction to re- investigate in the matter. He states that inspite of the aforesaid categorical directions, the respondents have not ensured fair investigation in the matter.
Learned A.G.A. submits that if the re-investigation has not been completed, the same would be done at the earliest.
In the facts and circumstances of the case, the present petition is disposed of directing the police authorities to conclude the investigation of the said case fairly, and impartially within a period of two months from the date of receipt of a certified copy of the order.
