Heard learned counsel for the petitioner, Sri Mohan Srivastava, learned counsel for the respondent LIC and Sri A. K. Goswami, learned counsel for the respondent no.1.
This petition has been filed for a direction upon the respondents to revoke petitioner's resignation and to accord him continuity of service.
It is not in issue that petitioner was in the employment of respondent Life Corporation of India and he had submitted his hand written resignation on 22.3.2018, which appears to have been got received in the office of Senior Divisional Manager on 22.3.2018 at 5.30 PM itself. This resignation has been accepted on 27.3.2018 w.e.f. 22.3.2018. The petitioner acquiesced to the acceptance of his resignation and no issue was raised then. After expiry of almost ten months a letter under RTI Act has been sent whereafter the present petition has been filed.
It is sought to be contended that a month's notice was mandatory, and therefore, the resignation could not have been accepted before it.
There is nothing on record to show that even within a period of one month petitioner attempted to withdraw his resignation. After expiry of more than a year it would not be open for the petitioner to raise a grievance regarding acceptance of his resignation, when it is acted upon.
Writ petition lacks merit and is, accordingly, dismissed.
