Heard Sri Zafar Naiyer, Senior Advocate assisted by Sri Himanshu Kumar, learned counsel for the petitioner and Sri Pranav Ojha, learned Additional Chief Standing Counsel for the State authorities.
Petitioner- Amit Kumar Katiyar Alias Amit Katiyar claims himself to be the owner and proprietor of the Anantraj Hospital, Akbarpur, Kanpur Dehat. He has filed this petition for the quashing of the enquiry report (Annexure-8) submitted by respondent nos.3 to 9 and wants a direction that the respondents should not interfere in the running of the aforesaid hospital by cancelling its registration or derecognizing it.
So far the registration of the hospital has not been cancelled nor it has been derecognized. No final action of any kind has been taken on the basis of the report referred to the above.
In view of the above, we are of the opinion that the writ petition as filed by the petitioner is premature and there is no cause of action for filing this writ petition.
The writ petition is accordingly dismissed with liberty to the petitioner to take appropriate measures as and when the cause of action arises.
