1. Heard learned counsel for the applicant and learned A.G.A. for the State.
2. This anticipatory bail application has been filed on behalf of the applicant - Amit Kumar @ Amit Prasad, seeking anticipatory bail in Case Crime No. 10 of 2021, under Sections - 363 & 366 I.P.C., Police Station - Kuber Sthan, District - Kushi Nagar, during pendency of trial.
3. As per instructions, Shri Sanjay Kumar Singh, learned A.G.A. submits that according to the case diary material the victim girl was born on 1.1.2006.
4. In view of the fact at present, according to the prosecution case the victim is minor, no interference is warranted in the present application.
5. Accordingly, the present anticipatory bail application is rejected, leaving it open to the applicant to apply for regular bail, which application when filed may be considered, on its own merit as expeditiously as possible, without being prejudiced by any observation made in this order.
