Aggrieved by the order dated 31.5.2017 by which a deficiency of stamp to the tune of Rs. 2,21,550/- was found, the petitioner had filed an appeal which was also dismissed on 18.4.2018. Against the two orders the instant writ petition has been filed.
Learned counsel for the petitioner has submitted that none of the grounds which was taken before the two authorities was considered by them.
Matter requires consideration.
Learned Standing Counsel may file a counter affidavit within a period of three weeks. Rejoinder affidavit may be filed within a period of two weeks thereafter.
List on 18.7.2018.
If the petitioner deposits 50% of Rs.2,21,550/- of the deficiency of stamp duty found by the order dated 31.5.2017 of the Assistant Commissioner/Collector, Stamp, Agra no recovery shall be done in pursuance of the impugned orders. Any amount which has been already deposited shall be adjusted towards the deposit the petitioner shall make under this order.
