Heard learned counsel for the petitioner.
Present petition has been filed for direction upon Principal Judge, Family Court, Mainpuri to decide the Divorce Petition No.82 of 2018 under Section 13B of Hindu Marriage Act (Amit Dixit Vs. Smt. Chetana) before the date fixed i.e. 8.8.2018.
The case of the petitioner is that similar issue has been raised before the Apex Court in the case of Amardeep Singh Vs. Harveen Kaur reported in (2017) 8 SCC 746, and Apex Court has considered the same.
Considering the facts of the case, the petition is disposed of with a direction to Principal Judge, Family Court, Mainpuri to consider the request of petitioner in light of the judgment of the Apex Court in the case of Amardeep Singh Vs. Harveen Kaur (supra) and if found fit, may pass appropriate order.
