Heard learned counsel for the petitioner and perused the record.
In view of the order proposed to be passed, notices need not issue to the respondent.
After some arguments counsel for the petitioner confined his prayer only to the effect to direct the Principal Judge Family Court No.1, District Bareilly to decide the application dated 31.10.2020, copy of which is appended as Annexure-9 to the petition.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of four months from the date of production of copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
