Heard learned counsel for the applicant and learned Additional Government Advocate.
It is argued by the learned counsel for the applicant that there is only extra-judicial confession of the co-accused Rajesh before the police in which the complicity of the applicant was disclosed and there was no other evidence connecting the applicant and the statement before the police is not admissible. Co-accused Brijesh Rai and Virendra Rai have been granted bail.
Per contra, learned AGA opposed the prayer for bail.
Having considered the submissions of the parties and without expressing any opinion on the merits of the case, let the applicant- Amit Rai, involved in case crime NO. 738 of 2009, under sections 147/148/304/201 IPC, police station Kasiya District Kushi Nagar, be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned.
