Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record.
This writ petition has been filed by the petitioner for quashing the order dated 17.10.2018 passed by the Commissioner, Agra Mandal, Agra in appeal no.1993 of 2018 as well as order dated 28.8.2018 passed by Addl. District Magistrate (Admn.), Agra in case no.5264 of 2018 under Section 3 U.P. Goonda Control Act, P.S. Jaitpur, District Agra. Further prayer has been made to direct the respondents not to initiate any coercive method against the petitioner.
Order of externment passed by the competent authority under U.P. Goonda Control Act against the applicant was challenged before the Commissioner concerned, which was approved.
Submission of learned counsel for the applicant is that only one case is pending against the applicant. Provision of Goonda Act is not applicable in this matter. Externment order passed in this case is illegal.
Learned A.G.A. opposed the prayer.
Having regard to the facts and circumstances of the case, hearing the parties and going through the observations recorded by the courts below, no illegality, infirmity or perversity is found in the orders impugned.
Writ petition is devoid of merit and is not liable to be allowed. It is accordingly dismissed.
