Heard learned counsel for the applicant, learned A.G.A., for the State and perused the record.
This bail application has been moved by the applicant Amir who is involved in Case Crime No. 282 of 2018, under Sections 147, 148, 149, 302 I.P.C., Police Station-Khekhara, District-Baghpat.
As per prosecution version, in the mid night of 14-15/5/2018, Ramnivas driver of the Truck was murdered by some unknown persons.
Learned counsel for the applicant contended that applicant has been made accused in this case on the basis of confessional statement before police on 17.6.2018. Before arrest in this case, applicant has no criminal antecedents. After arrest in this case, four other cases have been implanted upon the applicant. He further contended that co-accused Shoyab and Aadil @ Mamu have already been enlarged on bail vide orders dated 10.12.2018 and 11.11.2018 passed by this Court in Criminal Misc. Bail Application Nos. 44052 of 2018 and 41650 of 2018 respectively.
Learned A.G.A., has opposed the prayer for bail, however, admitted this fact that the applicant and other co-accused have been made accused on the basis of their confessional statement before the police. A knife used in the crime was recovered on the information of accused Aadil @ Mamu.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Amir, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
