The sole relief claimed in this application is that an appropriate direction be issued to the Addl. District & Sessions Judge, Court No.6, Meerut to expedite the trial in S.T. No.972/2017 (State vs. Tariq and others), arising out of Case Crime No.125/2017, under Sections 147/148/149/302/120-B IPC, P.S. Kotwali, Meerut.
The applicant claims to be one of the eye witnesses in respect of an occurrence dated 26.12.2016 as Case Crime No.666/2016, under Sections 147/148/149/302 IPC, P.S. Civil Lines, Meerut in which one Shamshad Kinnar (Sonali) was murdered, Rashid and Sadab sustained injuries.
It is submitted that during pendency of the above case, two eye witnesses, namely, Arif and Sadab @ Bhura of the above case were murdered, attributable to the accused persons in the present case, i.e., S.T. No.972/2017, (State vs. Tariq and others), arising out of Case Crime No.125/2017, under Sections 147/148/149/302/120-B IPC, P.S. Kotwali, Meerut, but till date charges have not been framed, coupled with imminent apprehension that remaining eye witnesses may also be murdered by the accused, an appropriate direction be issued to the trial court to conclude the trial, as expeditiously as possible.
Learned A.G.A has no objection.
This application is disposed of with the direction to the Addl. District & Sessions Judge, Meerut to expedite the trial of S.T. No.972/2017 (State vs. Tariq and others), arising out of Case Crime No.125/2017, under Sections 147/148/149/302/120-B IPC, P.S. Kotwali, Meerut, as expeditiously as possible, without granting unnecessary adjournments, adjournments, if any, shall be for strong and compelling reasons, else would attract exemplary cost.
The office of the Registrar General is directed to communicate this order to the court concerned forthwith.
