The petitioner has preferred the present writ petition with the prayer to direct the respondents to release the family pension in favour of the petitioner.
It is argued by learned counsel for the petitoner that the husband of the petitioner namely late Gama Hussain was retired from the post of Assistant Accountant in the year 2008 while working in the office of District Sugar Cane Officer, Deoria and he unfortunately died on 18.11.2020 leaving behind the petitioner (wife) and one daughter. It is argued that one Mariyam Khatoon is also claiming over the properties of the late Gama Hussain. It is argued that for the payment of family pension, the petitioner made various representations before the authorities from time to time but till date no final decision has been taken on the same.
Heard learned counsel for the parties and perused the record.
With the consent of learned counsel for the parties, this writ petition is disposed of permitting the petitioner to submit fresh representation ventilating all his grievances before respondent no.5 within a period of three weeks from today along with a certified copy of this order. If such a representation is filed within the stipulated period before him, the respondent no.5 is directed to pass appropriate orders within a period of three months from the date of filing of representation after providing opportunity of hearing to all the parties concerned including Mariyam Khatoon.
