1. Heard Ms. Paurami B. Sheth, learned advocate for the plaintiff.
2. As per the orders passed by the Hon ble the Chief Justice, the aforesaid suit was permitted to be listed for orders yesterday, wherein this Court had passed an order of arrest of the vessel in question, namely, M.V. Western Charm .
3. By this note for speaking to minutes, Ms. Sheth, learned advocate for the plaintiff invited attention of this Court that in the order dated 19.12.2012, the name of the vessel is wrongly typed as M.V. American Charm instead of M.V. Western Charm .
4. Considering the contents of the note for speaking to minutes and on perusal of the relevant papers and the record, it transpires that the vessel named in the order dated 19.12.2012 is wrongly mentioned. Hence, the vessel which is mentioned as M.V. American Charm in the order dated 19.12.2012 be read as M.V. Western Charm . It is further clarified that the vessel against which the arrest order is passed is M.V. Western Charm .
5. Accordingly, the note for speaking to minutes dated 20.12.2012 stands disposed of.
Direct service is permitted today.
