ORDER:
Heard learned Counsel for the petitioner and learned Standing Counsel for Respondents 1 and 3.
The petitioner states that the Amebedkarnagar Colony in Bommanagandi of Saroornagar Mandal was formed in the year 1984. A layout was prepared for the said colony by the Revenue Authorities for 324 plots in Sy.No.9/1 of Saroornagar, within the limits of the then L.B.Nagar Municipality. There are 360 houses with population of 4000 in the said colony. When there was no school, the residents of the said colony took up the issue and got sanctioned a school by the Government on 14.06.2001. Accordingly a school was constructed in Sy.No.9/1 of Saroornagar in the Government land. As the said school was not having a play ground though there was vacant land abutting the school building, upon the representation submitted by the then School Committee appointed under Section 5 of the A.P. School Education (Community Participation) Act, the then Revenue Divisional Officer, Ranga Reddy East wrote a letter to the District Collector, Ranga Reddy District on 21.07.2003 recommending allocation of 604 square yards in Sy.No.9/1 of Saroornagar for the purpose of using it as play ground of the said school children. When no action was taken, the present Writ Petition was filed.
Even after seven years of filing the Writ Petition, no counter affidavit is filed by the third respondent. In the circumstances, this Court has left with no option except to direct the second respondent to consider the letter wrote by the Revenue Divisional Officer, Ranga Reddy East vide Lr.No.B1/2398/03, dated 21.07.2003 and pass appropriate orders thereon within a period of six months from the date of receipt of a copy of the order. Accordingly there shall be an order. Till appropriate orders are passed by the second respondent as directed above, status quo granted by this Court on 08.02.2008 in respect of 2500 square yards comprised in Sy.No.9/1 of Saroorngar, Ranga Reddy District shall be maintained.
The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
