This anticipatory bail application under Section 438 Cr.P.C. has been moved seeking the bail of the applicant namely Ambar Pratap Singh, in the event of his arrest, who is involved in Case Crime No. 89 of 2019, under Sections 419, 420, 467, 468, 471, 274, 275, 276 of I.P.C., Police Station- Nibohara, District- Agra.
Heard learned counsel for the applicant and learned A.G.A. Perused the record.
It appears that spurious medicines were recovered and certain accused persons were also apprehended on the spot. The complicity of the applicant surfaced during the course of investigation. The allegation is that it is the applicant who manages the transport of the spurious drugs which is then further sent in packing in rural areas and boarder of Rajsthan. Such kind of criminal transaction and dealing with the spurious drugs is highly dangerous criminal activity capable to cause loss of life on mass scale. The applicant has yet not surrendered in the court and has not been apprehended so far. It appears that the nature of accusations and the case is such that investigation in the case must have allowed to have its full swing and interrogation of the applicant shall be necessarily essential for the purposes of investigation. This Court does not propose to put a spanner in the independent fair investigation in any manner whatsoever specially keeping in view the nature of accusation and the crime that has been committed and the involvement of the applicant which has surfaced on preliminary investigation.
After hearing the submissions made at the Bar, looking to the nature and gravity of the accusation and the material in support of the same and the overall circumstances of this case, this Court is of the view that the applicant has not made out a case for bail.
Accordingly, the anticipatory bail application is rejected.
