In view of the order passed by this Court [Coram : K. S. Jhaveri, J.] in Misc. Civil Application No.3123 of 2009 in Civil Application No.7227 of 2007 in First Appeal (Stamp) No.3486 of 2006 dated 8.8.2011 by which the appeal was restored and the main First Appeal (Stamp) No.3486 of 2006 has been dismissed, the Civil Application does not survive and accordingly, the present Civil Application stands disposed of as stated in the note placed on record by the Registry.
