1. We have heard learned Senior counsel Mr.Mihir Joshi, assisted by Ms.Megha Jani appearing for the appellants. With a view to enable the learned counsel for the appellants to take instructions with regard to death of respondent no.5, as according to respondent no.1's learned counsel Mr.Mansuri, respondent no.5 has died on 29.10.2010 and so that the parties may take instructions and move appropriate application.
2. Issue notice to the respondents returnable on 4.10.2012. Effect and operation of the order dated 31.8.2012 is stayed till 4.10.2012 passed in Special Civil Application No.8617 of 2010 passed by the learned Single Judge is stayed till then. Direct service is permitted.
