JUDGMENT / ORDER

Shah, learned Additional Public Prosecutor waives service of notice on behalf of the respondent-State.
The present application through jail has been preferred by the applicant-convict Ambalal Bhikhabhai to release him on temporary bail for a period of 30 days for agricultural purpose and/or for cutting the crops.
At the outset, it is required to be noted that his earlier application being Criminal Misc. Application No.4943 of 2013 for releasing him on temporary bail for cultivation purpose came to be rejected by the Division Bench vide order dated 5.11.2012. Therefore, if there can be cultivation in his absence, then, even in his absence the crop can be cut. Even otherwise, it is reported that the second furlough leave application of the application is pending before the IG (Prisons), which is sent to the office of IG (Prisons), State of Gujarat on 18th February 2013. Under the circumstances, the present application is dismissed. Rule is discharged. However, IG (Prisons) is hereby directed to finally decide and dispose of the furlough leave application of the applicant, which was sent to his office on 18th February 2013 at the earliest and in any case not later than four weeks from today.
