A.Mary Vimala vs The Director

Madras High Court|14 February, 2017

JUDGMENT / ORDER

The petitioner, who was admitted to in the third respondent's institute for two years Diploma in Teacher Education Course for the academic year 2010- 2011 had filed the present writ petition challenging the removal of her name from the college Rolls. As per the impugned order of the third respondent, dated 01.10.2010, the petitioner was not recognised as a destitute widow.
2.The learned Government Advocate appearing for the respondents 1 and 2 submitted that the petitioner, who was born on 15.06.1972 had crossed the eligible age of 30 years as on 31.07.2010 and since her certificate claiming to be a destitute woman was disbelieved by the Tahsildar, the impugned order has been rightly passed.
3. Heard both sides.
4.Today when this writ petition is taken up for hearing the learned counsel for the petitioner produced a certificate, dated 11.12.2014 issued by the Tahsildar of Kalkulam Taluk, Kanniyakumari District, certifying the petitioner to be a deserted woman, on the basis of field verification.
5. The counter filed by the second respondent states that the Tahsildar, Kalkulam Taluk, through his letter, dated 24.11.2011 addressed to the third respondent has stated that the petitioner cannot be considered as a deserted woman. However, the same Tahsildar has now issued a certificate certifying the petitioner to be a deserted woman. Hence, there is no impediment on the part of the third respondent to re-enroll the petitioner in the said course.
6.It is now brought to my notice that the petitioner has already completed the course and her results have been withheld. In view of my above observations, the petitioner is entitled to be re-enrolled into the college Rolls. Hence, the third respondent is directed to re-enroll the petitioner in the college Roll and declare her results of the examinations for the course of Diploma in Teacher Education. Such an exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.
8.With the above direction, this Writ Petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
