(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) Learned Counsel Mr. Deepak P. Sanchela for Respondent No.1 Municipality tendered affidavit in reply dated 27th February, 2012filed by Shri Chhaganbhai Becharbhai Rabari, Chief Officer of the Municipality. In the said affidavit, it is stated inter alia that the Special Leave Petition filed by the Municipality against the judgment of this Court came to be dismissed on 24.2.2012. It is further stated that thereupon, the Municipality has also issued cheque dated 24.2.2012 of the amount of Rs.13,58,168.00 towards the unpaid interest to the applicant. Such cheque is received by the applicant.
In view of the above development, no further action is necessary in the present contempt proceeding. Same is, therefore, closed. Notice is discharged. No order as to costs.
