Heard Sri Jawahir Yadav, learned counsel for the applicant and Sri Prashant Kumar, learned A.G.A. for the State.
This Application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to direct the learned Additional Judge, Court No. 3, Gautam Buddh Nagar to decide the Complaint Case No. 608 of 2016 (Amarpal Yadav Vs. Manish Yadav), under Section 138 N.I. Act P.S. Section 49 Noida, District Gautam Buddh Nagar expeditiously within short span of time.
Learned counsel for the applicant states that the present case under Section 138 N.I. Act is pending since 16.6.2018 and till date the same has not been not decided, hence a direction may be issued to the court below to the decide the same expeditiously.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of six months without permitting undue adjournments to either sides, if there is no legal impediment.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 as it is an innocuous order. If the O.P. No.2 feels aggrieved, he may approach this Court.
