Heard learned counsel for the petitioners and the learned A.G.A. for the State.
The instant petition has been filed with a prayer that the respondents may be directed to release the petitioner nos.1 to 6, who are being detained as bonded labours in the brick kilns run by the respondent no.4.
The learned counsel for the petitioners has invited attention of the Court to annexure no.1, which is an application moved by brother-in-law of petitioner nos.1,2, 4 and 5 and son-in-law of petitioner no. 3 and 6, who has also filed this petition for release of the petitioner nos.1 to 6. In the said application, which is dated 04.02.2019, addressed to the District Magistrate, Baghpat, it has been alleged that the petitioner nos.1 to 6 are being illegally detained and are being exploited as bonded labours without payment of wages.
The learned A.G.A. submits that no useful purpose would be served in keeping the petition pending as the petition can be disposed of requiring the district administration to take appropriate action on the application of the petitioners.
Considering the facts and circumstances of the case, this petition is disposed of with direction to the District Magistrate, Baghpat to enquire on the application of the petitioners moved on their behalf and in the event it is found that the petitioner nos.1 to 6 or any other person is being illegally detained or is being exploited for his labour by the respondent no.4, then action should be taken to secure the release of such persons. Such exercise should be completed within a period of 15 days from the date of filing of certified copy of this order along with copy of the representation which has been appended as Annexure No.1 to this petition before the District Magistrate,Baghpat.
