Heard Sri Mani Shanker Pandey, learned counsel for the applicant as well as learned AGA for the State and perused the record.
Present application under Section 482 Cr.P.C. has been filed by the applicant/complainant for a direction to the Court below to decide the Criminal Case No.1565 of 2020(State vs. Ashwani Kumar Patel and others) arising out of Case Crime No. 48 of 2020, under section 498A, 323, 506 IPC and section 3/4 Dowry Prohibition Act, Police Station Soraon, District Prayagraj/Allahabad pending before Additional Chief Judicial Magistrate, Court No. 17, Prayagraj/Allahabad, within a stipulated period.
It is submitted by the learned counsel for the applicant/complainant that aforesaid case against opposite party Nos. 2 to 4 is pending since 2020, but inspite of notice, they did not appear and case could not proceeded. The only prayer is to direct the Court concerned for expeditious disposal of the same.
Learned AGA has no objection to the prayer made in this application.
Without going into merit of the case, it is appropriate that the aforesaid Case be decided expeditiously.
In view of above, the Additional Chief Judicial Magistrate, Court No. 17, Allahabad is directed to expedite and conclude the proceedings of Criminal Case No.1565 of 2020(State vs. Ashwani Kumar Patel and others) arising out of Case Crime No. 48 of 2020, under section 498A, 323, 506 IPC and section 3/4 Dowry Prohibition Act, Police Station Soraon, District Prayagraj/Allahabad expeditiously as early as possible, without granting unnecessary adjournment to either side of parties.
With aforesaid direction, the application under Section 482 Cr.P.C. is finally disposed of.
