Heard Sri Saurabh Srivastava, learned counsel for the petitioners and Ms. Archana Upadhyay, learned AGA for the State.
This petition has been filed with a prayer to quash the order dated 2.4.2018 passed by Chief Metropolitan Magistrate, Kanpur Nagar in Criminal Case No.1639 of 2018 (State vs. Amarjeet and another).
Learned counsel for the petitioner submitted that the petitioner has challenged the impugned order earlier also vide Criminal Misc. Writ Petition No.23777 of 2017 in which the arrest of the petitioners has been stayed till the pendency of the investigation. It has been further submitted that further investigation has been ordered by the Investigating Agency which has been permitted by the learned Magistrate.
Investigating Officer is directed to further investigate the matter within a period of six weeks from the production of certified copy of this order.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the pendency of the investigation.
With the aforesaid direction, the petition is disposed of.
