Heard Mr. V.P. Singh, learned counsel for the petitioners, Mr. Amrendra Mani, Mr. Shiv Nath Singh and Mr. Hemant Kumar, learned counsel for the respondents.
By this writ petition, the petitioners seek a direction to respondents-authority not to demolish their shops without following due process of law. Learned counsel for the petitioners despite our specific query could not place any material on record in support of their apprehension of demolition of shops, except the fact that some marking was done by the concerned authority. It appears that one of the petitioners few years before had approached a Civil Court for similar relief, where the Civil Court, after taking evidence, passed such order.
In view thereof, it is not possible for this Court to enter into factual matrix and pass any order at this stage. It is always open to the other petitioners to take an appropriate remedy, including institution of a civil suit, if circumstances so demand, for similar relief. The petition is, accordingly, disposed of.
