Heard Sri Ajay Kumar Patel, learned counsel for the petitioner and learned Standing Counsel for the State respondent.
The proceedings for declaration of the land as Abadi land under Section 80 of the U.P. Revenue Code registered as Case No. 05 of 2018-19, Amareshwar Singh Vs. State of U.P., are pending before the learned Sub Divisional Magistrate, Kheragarh, District Agra.
Learned counsel for the petitioner Sri Ajay Kumar Patel contends that the proceedings are being delayed for no good reason. Inspection reports have been called for on more than one occasion even though there is no requirement of multiple inspection reports.
I see merit in the submission of the learned counsel for the petitioner.
Matter is remitted to the respondent no. 2, Sub Divisional Magistrate, Kheragarh, District Agra.
A writ of mandamus is issued commanding the respondent no. 2, Sub Divisional Magistrate, Kheragarh, District Agra to decide the Case No.05 of 2018-19, Amareshwar Singh Vs. State of U.P. under Section 80 of the U.P. Revenue Code within a period of two months from the date of receipt of a certified copy of this order after hearing all necessary parties.
The writ petition is disposed of finally.
