Heard learned counsel for the petitioner, learned Standing Counsel for the State respondents and Sri Azad Rai, learned counsel for the respondent no.5- Gram Sabha.
The present Public Interest Litigation (writ petition) has been filed for issuance a direction to the respondent no.3-Sub Divisional Magistrate/Assistant Collector (1st), Tehsil Sadar, District Mirzapur to decide the representation of the petitioner dated 17.08.2020.
It is contended by learned counsel for the petitioner that the land of Gata No.549 admeasuring area 1.0129 hectare and Gata No.550Kha admeasuring 2.0980 hectare recorded as pond/Bheeta in the revenue records has been occupied by the private respondent nos.6 to 11.
It is further contended by learned counsel for the petitioner that the representation in this regard has been filed by the petitioner on 17.08.2020, which is pending before the respondent no.3.
No useful purpose will be served by calling the counter affidavit and keeping the writ petition pending.
Under these circumstances, a direction is issued to the respondent no.3-Sub Divisional Magistrate/Assistant Collector (1st), Tehsil Sadar, District Mirzapur to decide the representation of the petitioner dated 17.08.2020 (Annexure No.9 to the writ petition) as expeditiously as possible preferably within a period of six months from the date of production of computerized copy of this order.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order. .
With the aforesaid observation, the writ petition is accordingly disposed of. Order Date :- 8.1.2021/P.S.Parihar
