This appeal is barred by limitation from 43 days. Ignoring the same, we have considered merits of the case.
This appeal is preferred to question correctness of the judgement dated 30th April, 2019 passed by learned Single Bench in Writ-A No.6776 of 2019.
By the order aforesaid, the learned Single Bench while calling upon the respondents to respond the contents of the petition for writ, rejected the prayer for interim relief.
It is submitted by learned counsel for the appellant-petitioner that the appellant was in employment of the respondent-school for last about 22 years and, therefore, the learned Single Bench should have granted interim relief as prayed for.
We do not find any merit in the argument advanced.
Learned Single Bench after taking into consideration all the relevant facts called upon the respondents to file a counter affidavit to the petition and while doing so also noticed that the appellant is son of the then Manager and as such no case is made out for grant of interim relief.
The rejection of prayer for interim relief is based on well founded principles for examining a request for interim relief.
The order does not suffer from error that may warrant interference in appellate jurisdiction. The appeal, hence, is dismissed.
The appellant-petitioner, if desires early hearing of the writ petition, he may move an application in that regard before the learned Single Bench.
