Supplementary affidavit filed today is taken on record.
Heard learned counsel for the petitioner and perused the record.
Present petition has been filed with a prayer that the Court below i.e. Executing Court/Additional Civil Judge (Senior Division), Bareilly be directed to expedite the hearing and decide objection dated 11.3.2019 filed by the petiitoner within a time bound period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the Executing Court/Additional Civil Judge (Senior Division), Bareilly to expedite the hearing of the aforesaid objection dated 11.3.2019 and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of two months, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
It is made clear that this Court has not considered the claim of the petitioner on merits.
With the aforesaid observations/ directions, the present petition is finally disposed of.
