Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Amar Srivastava @ Amar Saxena who is involved in Case Crime No. 232 of 2012 (S.T. No. 628/2012), under Sections 147, 148, 302/149, 504/149, 506/149 I.P.C., Police Station-Kalyanpur, District-Kanpur Nagar.
As per prosecution version, on 17.12.2012 at about 8:00 PM some unknown person fired on Abhisekh Chauhan due to which he sustained injuries and succumbed due to injuries.
Learned counsel for the applicant contends that police has submitted final report in respect of applicant on the basis that location of applicant and deceased was at different place. Role of causing fire arm injury is assigned to co-accused Situ Yadav, Ankur Solanki, Sunti and Annoo Awasthi. He further contends that co- accused Anno Awasthi @ Arun Awasthi, Ankur Solanki Shunti have already been enlarged on bail vide orders dated 27.8.2012, 17.9.2012 and 19.2.2012 passed by this Court in criminal misc. bail application nos. 21549/2012, 23770/2012 and 24137/2012 respectively. He further contends that there are two cases pending against the applicant in which, applicant is on bail.
Learned A.G.A., has opposed the prayer for bail.
Considering the fact that applicant has been summoned under Section 319 Cr.P.C., and the three aforesaid accused have already been enlarged on bail, I find it a fit case for enlarging the applicant on bail. Let the applicant-Amar Srivastava @ Amar Saxena, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
