Heard Shri Sanjay Kumar Yadav, learned counsel for petitioner and and learned A.G.A. for State of Uttar Pradesh and perused the material placed on record.
Learned counsel for the petitioner prays for and is permitted to make necessary correction in the stay application during the course of the day.
This writ petition has been filed for quashing the F.I.R. dated 09.09.2018 registered as Case Crime No. 0532 of 2018, under Sections 419, 420, 467, 468, 471, 120-B I.P.C., Police Station- Bhongaon, District- Mainpuri.
In the F.I.R. in substance the allegation has been made that various persons got their names recorded over the land of gaon sabha without there being any valid patta in their favour.
Counsel for the petitioner submits that petitioner was not involved in the aforesaid entry and he has no knowledge about it.
In view of the fact of present case writ petition is disposed of with the direction that petitioner shall not be arrested in Case Crime No. 0532 of 2018, under Sections 419, 420, 467, 468, 471, 120-B I.P.C., Police Station- Bhongaon, District- Mainpuri, till the submission of report by Investigating Officer under Section 173(2) Cr.P.C.
