Heard Sri Shami Ullah, learned counsel for the applicant, Sri Sanjay Kumar Singh, learned AGA for the State and perused the record.
The anticipatory bail application under Section 438 Cr.P.C. has been filed by the applicant Amar Singh, seeking anticipatory bail, in the event of arrest in Case Crime No.463 of 2021, under Sections 386, 388, 452, 500, 504, 506 IPC, Police Station Deoband, District Saharanpur.
Learned counsel for the applicants states while placing para no.8 of the affidavit in support of anticipatory bail application that special situation in the present case is that the personal liberty of the applicant is at stake and hence he has no option except to approach this Court by filing present anticipatory bail application under Section 438 Cr.P.C. without approaching the court below.
The reason as given in para no.8 of the affidavit for approaching this Court directly is not convincing at all and does not impress the Court as being special reason to entertain the present anticipatory application under Section 438 Cr.P.C. The present anticipatory bail application is thus dismissed.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the applicant(s) along with a self attested identity proof of the said person(s) (preferably Aadhar Card) mentioning the mobile number(s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
