JUDGMENT / ORDER

Heard learned Counsel for the applicant and learned AGA for the State.
The applicant seeks bail in Case Crime No. 366of 2010 under Sections 8/22 N.D.P.S. Act, P.S. Devgaon, District-Azamgarh. It is contended by learned counsel for the applicant that the recovered quantity of 126 gms of Diazepam is below than the commercial quantity and Sections 8/22 of N.D.P.S. Act have not been complied with. He further contended that the applicant does not have any criminal history. He further submitted that the applicant has been falsely implicated at the behest of the police.
Learned AGA also could not dispute the criminal history of the applicant under the N.D.P.S. Act.
Since, the applicant does not have any criminal history, I consider it appropriate to release the applicant Amar [email protected] Amarjeet Singh, on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of Special Judge, N.D.P.S. Act, Azamgarh, in Case Crime No. 366 of 2010 under Sections 8/22 N.D.P.S. Act, P.S. Devgaon, District- Azamgarh.
