Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with the prayer to direct the respondent no. 3 Sub Division Magistrate, Phoolpur, Allahabad to decide the Case No. 73 of 2018 (Amar Nath Vs. Chanda Devi), under Sections 145/146 CrPC, Mauja Shuklana, P.S. Phoolpur, District Allahabad.
It is submitted by learned counsel for the applicant that on the application of the applicant, proceedings under Section 145 CrPC has been initiated vide order dated 16.03.2018 and the same is pending before the Sub Divisional Magistrate, Phoolpur, Allahabad since then.
It has been stated by learned counsel for the applicant that the Sub Divisional Magistrate may be directed to expedite the proceedings and bring the same to a logic conclusion.
Considering the facts and circumstances of the case, Sub Divisional Magistrate is requested to make all endeavours to conclude the proceedings of the Case No. 73 of 2018 (Amar Nath Vs. Chanda Devi), under Sections 145/146 CrPC, Mauja Shuklana, P.S. Phoolpur, District Allahabad, after giving opportunity of hearing to both the parties, preferably within a period of six months from today, provided there is no other legal impediment in concluding the aforesaid proceedings.
With the aforesaid directions, this application is finally disposed of.
