Rejoinder affidavit filed today which is taken on record.
Heard learned counsel for the applicants and learned A.G.A. for the State.
The applicants, by means of this application under Section 482 Cr.P.C. have invoked the inherent jurisdiction of this Court with a prayer to quash the entire proceedings of Criminal Case No. 3868 jof 2012 (State vs. Amar Nath Prajapati), under Sections 498A, 323, 506 I.P.C. and 3/4 D.P. Act, P.S. Phoolpur, District Varanasi.
It is submitted by learned counsel for the applicants that the present matter relates to a matrimonial dispute between husband and wife and the said matter can be well considered by Mediation Centre of this Court.
It is directed that applicants shall deposit a sum of Rs. 20,000/- within two weeks from today with the Mediation Centre which shall be paid to the opposite party no. 2 for her appearance before the Mediation Centre.
The matter is remitted to the Mediation Centre with the direction that the Mediation Centre shall conclude the Mediation and conciliation proceedings expeditiously, preferably within a period of three months after giving notices to both the parties.
List after three months before the appropriate court.
Till the next date of listing, further proceedings of the aforesaid case shall remain stayed against the applicants, pending in the court of A.C.J.M., 8th, Varanasi, subject to the applicants' depositing proof of deposit of Rs. 20,000/- before the Mediation & Conciliation Centre of this Court.
After the aforesaid amount is deposited, notice shall be issued to the parties and in the case the aforesaid amount is not deposited within the aforesaid period, this application shall automatically stand dismissed.
