Heard learned counsel for the petitioner as well as Sri Nand Lal Maurya, learned Standing Counsel appearing for the State respondents and Sri Ram Babu Yadav, learned counsel appearing for the Gaon Sabha.
Present writ petition has been filed seeking a direction to the respondent no. 3, the Assistant Collector, Tehsil Gyanpur, district Bhadohi to remove the illegal encroachment of respondents no. 5 to 10 from river bed, Gata no. 126/0.5560, 164/0.2390, 458/0.5730, 469/0.1600m 470/0.0630,
2413/0.5910 and 2456/0.9950 (total 22 plots) admeasuring 5.6010 Hectares) situated in revenue village Kasidahan, Tehsil Gyanpur, district Bhadohi expeditiously within a stipulated period.
Pursuant to the order dated 20.12.2018, learned Standing Counsel has produced a copy of the instructions, which is taken on record. Alongwith the instructions learned Standing Counsel has produced original copy of the report of Three Member Committee which has carried out the measurement and has filed spot inspection report according to which there is no encroachment on the plots in question. Coloured photographs of the spot have also been annexed.
In such view of the matter, no further directions are required by this Court. This writ petition is, accordingly, dismissed. No order as to costs.
