Heard learned counsel for the petitioners and learned A.G.A. for the State through Video Conferencing.
By means of this petition, petitioners seek issuance of a writ in the nature of certiorari quahsing First Information Report bearing Case Crime No.070 of 2021, under Sections 363, 366 I.P.C., Police Station Kamlapur, District Sitapur.
From a bare perusal of the imupugned F.I.R, it can not be said at this stage that no cognizable offence is made out against the petitioners. Therefore, we are not inclined to entertain this petition. It is accordingly dismissed, however, without prejudice to the rights of the petitioners to avail other remedies under Sections 438/ 439 Cr.P.C. as the case may be, as per law.
