The petitioner claims that his Adhar Card has been incorrectly linked to the Adhar Card of another person namely Surya Kant Pandey. Further the petitioner is being denied the benefit of U.P. Government Farmer Loan Redemption Scheme.
The only prayer made by Shri Shiv Shankar Singh, learned counsel for the petitioner is that the grievance of the petitioner may be redressed within a stipulated period of time.
Learned Standing Counsel in his usual fairness submits that the respondents authorities are under an obligation of law to decide the representation of the petitioner within a stipulated period of time and in case he is eligible for benefit of the aforesaid scheme, the same has to be released in accordance with law as well.
Considering the submissions of learned counsel for the parties, no useful purpose would be served by exchanging the pleadings and keeping this writ petition pending. With consent of parties, the writ petition is being disposed of.
The matter is remitted to the respondent no. 2-District Magistrate, Allahabad as well as the respondent no.3- Branch Manager, Bank of Baroda, Branch Pasna, Allahabad.
A writ in the nature of mandamus is issued commanding respondent no. 2-District Magistrate, Allahabad as well as the respondent no.3-Branch Manager, Bank of Baroda, Branch Pasna, Allahabad to execute the following directions:
I. The respondent no. 2-District Magistrate, Allahabad as well as the respondent no.3-Branch Manager, Bank of Baroda, Branch Pasna, Allahabad, shall decide the representation of the petitioner for removing the link of his Adhar Card with that of Surya Kant Pandey and also consider his case for grant benefit of U.P. Government Farmers Loan Redemption Scheme within a period of one month from the date of receipt of a computer generated copy of this order, downloaded from the website of High Court, Allahabad. Authority/official shall verify the authenticity of such computerized copy of the order from the official website of High Court, Allahabad and shall make a declaration of such verification in writing.
II. In case the application is not decided within the above stipulated period of one month, it shall be open for the petitioner to approach this Court again with the same relief. In that event, the costs of the litigation shall be borne by the respondent no. 2-District Magistrate, Allahabad as well as the respondent no.3-Branch Manager, Bank of Baroda, Branch Pasna, Allahabad.
It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor has judged the claim of the petitioner on merit. It is for the competent authority to do so after independent application of mind and in accordance with law.
The writ petition is disposed of.
