Heard learned counsel for the petitioner and Sri S.K. Upadhyay, learned Standing Counsel appearing for respondents no. 1 to 4 and perused the record.
Present petition has been filed seeking writ of mandamus commanding and directing the respondent authorities to conclude the proceedings pursuant to the show cause notice dated 30.07.2018 issued by the office of the District Magistrate, Bulandshahar Under Section 95 (1)(g)(iii) of Uttar Pradesh Panchayat Raj Act, 1947 (as amended in year 1994) and take final decision forthwith pursuant to the complaint made against the Gram Pradhan of Gram Panchayat Kamalpur, Block and District- Bulandshahar.
Submission of learned counsel for the petitioner is that in spite of show cause notice dated 30.07.2018, whereby 15 days' time was granted to respondent no. 5 to file his reply to the show cause notice, the same have not be concluded. It is further submitted that under the Enquiry Rules, 1997, in such matters, time limit has been provided to conclude the preliminary enquiry as well as the final enquiry.
Accordingly, the present petition stands disposed of with a direction to respondent no.2 to pass final orders pursuant to the show cause notice dated 30.07.2018 on its own merits without being influenced by any observations made in this order preferably within a period of one month from today.
