This petition for writ is preferred to challenge the order dated 4/5.1.2018, passed by the Tehsildar, Tehsil Harraiya, District Basti denying for issuance of Backward Class (Muslim Kayashtha) certificate to the petitioner.
As per Government Order No. 685 dated 26.3.2011, the issue with regard to caste of a person is required to be scrutinized by the District Level Committee consisting of District Magistrate and a member nominated by District Magistrate not below the rank of Additional District Magistrate, a Sub-Divisional Magistrate nominated by the District Magistrate, District Social Welfare Officer (SC/ST) and District Backward Class Welfare Officer.
Therefore, the petitioner may agitate his cause before the District Level Committee by way of submitting a representation with all necessary details to claim the O.B.C. certificate.
The writ petition is disposed of keeping the petitioner at liberty as stated above. If the petitioner submits any application, that shall be considered by the District Level Committee expeditiously.
