Heard learned counsel for the parties.
Petitioner came to be selected as Constable in Direct Recruitment 2015. By the instant writ petition, petitioner seeks following relief:
"To issue a writ, order or direction in the nature of mandamus commanding the respondent no.3 to permit the petitioner to join his duties as Constable Trainee under him forthwith or pass detailed reasoned and speaking order in writing cancelling the candidature of the petitioner keeping in view of the representation made by the petitioner dated 17.04.2019 within the period so stipulated by this Hon'ble Court.
(ii) To issue a writ, order or direction in the nature of mandamus commanding the respondent no.3 to pass reasoned and speaking order upon the representation of the petitioner dated 17.04.2018 in the light of Avatar Singh case and to serve the copy of the order so passed within the stipulated period."
Learned Standing Counsel submits that the third respondent shall pass appropriate order, in accordance with law.
In view thereof, on consent, the petition is disposed of directing the third respondent-District Nodal Officer/Commandent 26th P.A.C. Battalion, District Gorakhpur, to consider and decide the representation of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of two months from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
