Heard Sri Rajesh Tewari, learned counsel for the applicant and Sri G.P. Singh, learned A.G.A. for the State.
This transfer application has been moved with the prayer to transfer the case crime no. 108 of 2019, under Section 386, 420, 467, 468, 471 and 506 IPC, P.S. Jangipur, pending before the Juvenile Justice Board, Ghazipur to Varanasi because the Juvenile Justice Board at Ghazipur is lying vacant.
A report was summoned from the registry and it has been submitted vide report dated 25.11.2019 to the effect that Sri Ghanshyam Shukla has been posted as A.C.J.M., Ghazipur vide High Court's notification dated 24.9.2019 so that the District and Sessions Judge, Ghazipur may nominate him as Principal Magistrate, Juvenile Justice Board, Ghazipur.
In view of above report, it is apparent that Sri Ghanshyam Shukla has now been posted as A.C.J.M., Ghazipur, who has to be nominated by the District and Sessions Judge, Ghazipur as Principal Judge, Juvenile Justice Board, Ghazipur.
I expect that the said Officer would soon be nominated as Principal Magistrate, Juvenile Justice Board, Ghazipur by the District & Session Judge, hence I do not see any ground to allow this transfer application. Accordingly, the present transfer application is disposed of as it has become infructuous.
