Heard learned counsel for the applicant and learned AGA for the State-respondents.
The present bail application has been filed for enlarging the applicant on bail in Case Crime No. 208 of 2020, under Section 307 I.P.C., Police Station -Mohammadabad, District -Farrukhabad.
It is contended by learned counsel for the applicant that the applicant has been falsely implicated in the present case. It is a police firing case in which applicant himself has received injury by the police personnel. He further submitted that applicant has been implicated only because of his previous criminal history. He also submitted that applicant is languishing in jail since 19.07.2020.
Per contra, learned A.G.A. has vehemently opposed the bail application and submitted that it is a bona fide police encounter case in which applicant has received injuries. Apart from that applicant is having criminal history of 17 cases out of which many cases are pertaining to sections 302, 307, 392, 395 IPC etc. Applicant is a habitual criminal, therefore, no case is made out for granting bail.
Considering the facts and circumstances of the case, criminal history of the applicant, the gravity of the offence, the nature of accusations and severity of punishment in case of conviction, there does not appear any good ground to release the applicant on bail.
At this juncture, learned counsel for the applicant prayed that the trial is proceedings at snail's speed, hence the trial court be directed to conclude it within some time bound period.
However, the trial court is directed to make all possible efforts to conclude the trial expeditiously, if possible, within a period of nine months from the date of production of computer generated copy of this order.
With the aforesaid observations, the bail application is rejected. Order Date :- 28.7.2021 Sartaj
