JUDGMENT / ORDER

1. Petitioner, admittedly, is a physically disabled student, who had applied for the three year LL.B. Course and had been allotted to the fourth respondent college. Petitioner had also been allotted in the vacancy for the physically disabled. Further, for allotment purpose, the petitioner will have to produce the mark-list qualifying him in the graduate examination.
2. Petitioner, admittedly, had taken his graduate degree in B.A. (Economics) from the additional fifth respondent college. He had not appeared in the internals of the fourth semester at the time when it was regularly scheduled. Later on, along with the 6th semester final examinatiuon, the petitioner appeared in the internals of the fourth semester. He is, admittedly, qualified in the internals also, as is evident from Ext.P2 mark-list. Petitioner's mark-list for all other W.P.(C)No.27950 of 2014 -:2:-
examinations are also available with him. Only for reason of non- publication of Ext.P1/P4 mark-list, the petitioner had not been granted his allotment.

Learned counsel for the additional fifth respondent would submit that, since the petitioner had appeared for the 2nd semester internals along with the final year examinations, the mark-lists could be drawn up only on 3.6.2014. The same was uploaded on 3.6.2014 itself and in Form-B1, the same was forwarded to the University on 4.7.2014. Learned standing counsel for the University would submit that, since the mark-list was forwarded, the publication can be made only along with the publication of the regular 4th semester examinations. Admittedly, going by the above facts, the petitioner had qualified in his graduate degree. There is none other in the disabled category, who can be admitted to the 4th respondent college.
4. In such circumstances, on the petitioner producing before the Principal of the fourth respondent college the entire mark-list issued W.P.(C)No.27950 of 2014 -:3:-
by the University along with the internal mark-list available in the site of the University, the petitioner shall be granted admission as per the allotment. Petitioner's admission shall be provisional and on publication of the results by the University, the petitioner shall be obliged to produce the certificate before the fourth respondent.
Writ petition is allowed.
