Heard Ms. Shruti Pandey learned counsel for the petitioner and Sri Vikram Bahadur Yadav learned Standing Counsel for the State.
This petition has been preferred seeking the following reliefs:-
"Issue a writ of mandamus directing the respondent No.2 to correct the gender category mistake in the online application form.
Issue a writ of mandamus directing the respondent no.2 to call the petitioner for his Medical Examination.
Issue a writ of mandamus directing the respondent no.2 to produce the total marks of the petitioner."
The case of the petitioner who had appeared and participated in the 2013 recruitment was that she had mistakenly while filling the online application form selected the category of Male instead of Female. It was in that background that the learned Standing Counsel had been directed to obtain instructions.
Sri Yadav learned Standing Counsel has apprised the Court that at the time of initiation of the selection process and consequent to this mistake coming to light, the petitioner had made a representation which was duly accepted by the Board and consequently her candidature was evaluated treating her to be a female candidate. According to Sri Yadav she was not declared successful initially since she had failed to obtain the marks equivalent or more than the cut off then declared. He however fairly conceded before the Court on behalf of the State respondents that the cut off marks with respect to 2013 recruitment are to be now finally declared in light of the directions issued by the Court while passing orders in Writ-A No. 18442 of 2018.
In view of the above learned Standing Counsel states that the claim of the petitioner shall be duly evaluated and considered after the publication of the final result in light of the directions issued by this Court on the writ petition aforementioned.
Accordingly this petition shall stand disposed of in light of the statement noted above.
