Heard Sri Ajay Kumar, learned counsel for the petitioner and learned Standing Counsel for respondents State.
This writ petition has been filed with the following prayers:-
"a) issue a writ, order or direction in the nature of MANDAMUS directing the respondents to correct date of birth of the petitioner as 01.07.2001 instead of 28.10.2000 and also correct the name of the petitioner as Amita Kumari instead of Km. Amita Bharti in the High School-2015 and Intermediate-2017 mark sheet/certificate as petitioner scholar's register and transfer certificates and as per recommendation letter of the respondent no. 4 and 5.
b) issue a writ, order or direction in the nature of MANDAMUS directing the respondents to issue the corrected mark sheet/certificate of High School-2015 and Intermediate-2017 to the petitioner, within stipulated period of time as fixed by this Hon'ble Court."
It is contended that the petitioner had applied for certain corrections in her High School and Intermediate Marks Sheets. Ventilating her grievance, petitioner had moved an application before College on 06.12.2018. The College had recommended for the correction in the name and date of birth of petitioner to respondent no. 3 on 04.02.2019. The said correspondence has been brought on record as Annexure-8 to the writ petition. The sole prayer of the petitioner is for a direction upon respondent no. 3 to take decision on the recommendation forwarded by the Institution.
Learned Standing Counsel does not oppose the limited prayer so made for early disposal of the application.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no. 3 to take decision on the recommendation sent by the College for correction of name and date of birth of petitioner, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of three months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
