This writ petition has been filed challenging the impugned order of the third respondent, dated 4.11.2009, in respect of the short levy of peak hour charges and for fixing demand and energy quotas, relating to the petitioner's company and for the issuance of a direction to the respondents to fix the demand and energy quotas for the petitioner's factory.

The learned counsels appearing on behalf of the petitioner, as well as the respondents had submitted that this Court had passed an earlier order, dated 28.8.2009, in W.P.No.14461 of 2009, wherein, similar issues had arisen for the consideration of this Court. This Court had ordered as follows: "2(1) The Board re-fixing energy quota and demand quota in respect of wind Energy generators has filed 2 memos, dated 4.8.2009 and 21.8.2009, before the Tamil Nadu Electricity Regulatory Commission, Chennai. 2(2) The commission referred to above shall decide about the same after hearing the parties concerned.
2(3) Till such time the respondent board shall not enforce the penalty for the past claim, as well as the future claim.
3. The learned counsels appearing on behalf of the respondents have no objection for this Court passing a similar order, as shown above.
4. The writ petition is ordered accordingly. No costs. Consequently, connected miscellaneous petitions are closed.
