1.0 The applicant is permitted to join 'The Balasinor City Co-operative Credit Society Ltd., Balasinor' as a party respondent No. 2, to be served through the Managing Director.
2.0 Rule, returnable on 10th January 2012. Learned Additional Public Prosecutor Ms. Shah waives service of Rule on behalf of respondent No. 1 - State of Gujarat.
2.1 I have perused the First Information Report (FIR), Annexure 'A' - Report under Section 86 of the Gujarat Co-op. Societies Act, 1961 dated 10th June 2010, Additional Affidavit filed on behalf of the petitioner and as per the judgment renedered by the Honourable the Apex Court in the matter between Siddharam Satlingappa Mhetre Vs. State of Maharashtra, reported in (2011) 1 SCC 694, it is directed that the petitioner shall not be arrested in connection with the Crime Register No. I-61/2010, registered with the Balasinor Police Station on 9th August 2010 till the next date of hearing.
3.0 Direct service is permitted.
