Mr.HM Prachchhak, learned advocate for the petitioner submitted that pursuant to the order dated 27.1.2012, his client, the petitioner has remained personally present in this Court. Mr.HK Patel, learned advocate for respondent No.1 submitted that because of some disturbance in Junagadh, today, his client - respondent No.1 could not remain present before this Court. However, when it was pointedly asked as to on next adjournment date, whether the respondent No.1 is going to remain present or not. To this, Mr.HK Patel, learned advocate for the respondent No.1 submitted that he is not sure about it.
When above is position, this Court is of the opinion that the order dated 27.1.2012 passed by this Court to provide the platform to the parties to explore the possibility of settlement, is required to be recalled. Any amount, pursuant to said order, if deposited by the petitioner in this Court, shall be returned to him. S.O to 2.3.2012.
