The petitioner has challenged the notice inviting tender for "user fee collection plaza" for a period of one year on the basis of the e-tendering.
Learned counsel for the petitioner is not present. We have heard learned counsel for the respondents and learned Standing Counsel.
Having regard to the fact that the e-tender was invited for a period of four years and no interim order was granted at the time when the writ petition was moved. The writ petition has become infructuous by efflux of time.
Accordingly, the writ petition is dismissed.
However, we grant liberty to the petitioner to move a recall application in case, the cause of action still survives or this order cause any prejudice to his interest.
